MOVILGMAO APP es una aplicación desarrollada por NUEVA GESTION INFORMATICA, S.L.y destinada al uso por parte de empresas o entidades públicas, requiriendo para su uso el establecimiento de un contrato de servicios, en donde se detallan todas las condiciones para su suministro, soporte y mantenimiento.
El acceso a la aplicación, por parte de los empleados de la compañía contratante, se hará a través de un usuario y contraseña.
Debido a que MOVILGMAO APP es una aplicación configurable por el cliente, es responsabilidad de la compañía contratante informar a sus empleados, clientes y terceras personas, de las características de los datos a recopilar, solicitar su consentimiento, indicar su finalidad, destino, uso previsto, conservación, sus derechos de cancelación o cualquier otro derecho o información necesaria, así como mantener una política de seguridad y contraseñas seguras.
Cuando un cliente configura nuestra aplicación puede utilizar servicios que proporcionamos para darle funcionalidades especiales. Entre estos servicios se encuentran funcionalidades como: acceso a la cámara para poder guardar fotos/videos en los formularios o leer códigos QR, acceso al micrófono para poder guardar notas de voz o utilizar la conversión de voz a texto, acceso a Bluetooth para poder conectar con dispositivos externos y capturar mediciones, acceso al NFC para poder leer y escribir etiquetas NFC asignadas a un activo, acceso al estado de red o wifi para saber si tenemos cobertura o si subimos archivos pesados directamente o esperamos a tener wifi, acceso a escribir/leer/modificar en dispositivos externos para guardar los documentos en ellos, acceso al estado del teléfono y su IMEI para poder gestionar los logs de conexiones y las licencias, acceso para iniciarse automáticamente cuando el dispositivo se encienda para poder recibir mensajes push o transmitir la ubicación periódicamente para que el responsable pueda asignar ordenes de trabajo basándose en la ubicación, todo ello aunque la aplicación no esté en uso,.
Todos estos datos que se recopilan son propiedad del cliente y solo concede permiso limitado a NUEVA GESTION INFORMATICA, S.L. para tratar estos datos en el ámbito del servicio contratado, es decir, el suministro, soporte y mantenimiento de la aplicación MOVILGMAO APP.
NUEVA GESTION INFORMATICA, S.L no intercambia ni usa los datos, para ningún propósito que no sea el suministro, soporte y mantenimiento del servicio para sus clientes. De este modo los únicos intercambios de información que existen son con sus proveedores de servicios en la nube, para recoger, almacenar, retener y gestionar los datos (todos ellos en el Espacio Económico Europeo) y con aquellos que tenga una obligación legal. Los datos de nuestros clientes NO se venden, ni se usan para otro fin distinto.
Dentro de las características configurables en MOVILGMAO APP, existe la posibilidad de establecer varios niveles de acceso a la ubicación del dispositivo, tanto en primer plano como en segundo plano. El cliente decide, mediante la configuración, que nivel de acceso a la ubicación necesita según las características de su negocio. Es posible, la configuración sin acceso a la ubicación, con acceso en primer plano o con acceso en segundo plano. Es responsabilidad del cliente informar a sus usuarios de que configuración ha realizado, previamente a darles acceso a la aplicación, recabando su consentimiento en caso de que sea necesario. No obstante, MOVILGMAO APP muestra un aviso sobre el uso de esta configuración y el usuario siempre puede rechazarlo, lo que hará que la aplicación no pueda ser usada con esta configuración.
El acceso a la ubicación en segundo plano es requerido por algunos clientes para que el responsable pueda asignar ordenes de trabajo según la ubicación del usuario, aún cuando la aplicación no este activa. De este modo se consigue optimizar los desplazamientos de los empleados y atender con mayor rapidez a sus clientes.
Como ya se indicó anteriormente, NUEVA GESTION INFORMATICA, S.L no intercambia ni usa estos datos, para ningún propósito que no sea el suministro, soporte y mantenimiento del servicio para sus clientes.
NUEVA GESTION INFORMATICA, S.L. y la empresa usuaria de la aplicación se encuentran vinculadas por una relación contractual de prestación de servicios consistente en el suministro y mantenimiento de la aplicación MovilGmao®. En el caso de que la prestación de los servicios suponga la necesidad de acceder a datos de carácter personal por parte de NUEVA GESTION INFORMATICA, S.L., este hecho tendrá la consideración de acceso y nunca de comunicación o cesión de los mismos. Por ello, la empresa usuaria de la aplicación deberá facilitar a NUEVA GESTION INFORMATICA, S.L. el correspondiente contrato de encargado del tratamiento el cual habrá de ser aceptado y firmado por este último. Todo ello en cumplimiento de la Ley Orgánica 3/2018, de 5 de diciembre de 2018, de Protección de Datos Personales y garantía de los derechos digitales, así como al Reglamento (UE) 2016/679 del Parlamento Europeo y del Consejo, de 27 de abril de 2016, relativo a la protección de las personas físicas en lo que respecta al tratamiento de datos personales y a la libre circulación de estos datos y demás normativa que pudiera ser de aplicación.
NUEVA GESTION INFORMATICA, S.L. comunica en este escrito a la empresa usuaria de la aplicación y ésta expresamente así lo declara conocer y aceptar, que en ningún caso aceptará ser encargado de tratamiento de aquellos datos personales que revelen el origen étnico o racial, las opiniones políticas, las convicciones religiosas o filosóficas, o la afiliación sindical, así como datos genéticos, datos biométricos dirigidos a identificar de manera unívoca a una persona física, datos relativos a la salud o datos relativos a la vida sexual o la orientación sexual de una persona física.
Se declara en este documento la empresa usuaria de la aplicación informada de esta renuncia caso de que el acceso a los datos sea necesario para la prestación del servicio.
El titular de los datos podrá ejercitar los derechos de acceso, rectificación, limitación de tratamiento, cancelación, portabilidad y oposición dirigiéndose por escrito a la siguiente dirección: NUEVA GESTIÓN INFORMÁTICA, S.L. en Fray Ceferino 24, 3º, 33001 Oviedo o a través de correo electrónico ngi@ngi.es.

The terms used in this Privacy Policy says that MOVILGMAO APP is an application developed by NUEVA GESTION INFORMATICA, S.L. and intended for use by companies or public entities, requiring for its use the establishment of a service contract, where all the conditions for its supply, support and maintenance are detailed.

When a client configures our application, he can use services that we provide to give him special functionalities. All this data that is collected is the property of the client and only grants limited permission to NUEVA GESTION INFORMATICA, S.L. to process this data within the scope of the contracted service, that is, the supply, support and maintenance of the MOVILGMAO APP application.
NUEVA GESTION INFORMATICA, S.L does not exchange or use the data, for any purpose other than the supply, support and maintenance of the service for its clients. In this way, the only information exchanges that exist are with your cloud service providers, to collect, store, retain and manage data (all of them in the European Economic Area) and with those who have a legal obligation. The data of our clients is NOT sold, nor used for any other purpose.
Within the configurable characteristics in MOVILGMAO APP, there is the possibility of establishing various levels of access to the location of the device, both in the foreground and in the background. The client decides, through the configuration, what level of access to the location he needs according to the characteristics of his business. Configuration without location access, foreground access, or background access is possible. It is the client's responsibility to inform their users of what configuration they have made, prior to giving them access to the application, obtaining their consent if necessary. However, MOVILGMAO APP shows a warning about the use of this configuration and the user can always reject it, which will make the application unusable with this configuration.
Access to the location in the background is required by some clients so that the manager can assign work orders according to the user's location, even when the application is not active. In this way, it is possible to optimize employee travel and serve your customers more quickly.
As already indicated above, NUEVA GESTION INFORMATICA, S.L does not exchange or use this data, for any purpose other than the supply, support and maintenance of the service for its clients.
NUEVA GESTION INFORMATICA, S.L. and the company using the application are bound by a contractual service provision relationship consisting of the supply and maintenance of the MovilGmao® application. In the event that the provision of services involves the need to access personal data by NUEVA GESTION INFORMATICA, S.L., this fact will be considered access and never communication or transfer of the same. Therefore, the company using the application must provide NUEVA GESTION INFORMATICA, S.L. the corresponding contract of the person in charge of the treatment which will have to be accepted and signed by the latter. All this in compliance with Organic Law 3/2018, of December 5, 2018, on the Protection of Personal Data and guarantee of digital rights, as well as Regulation (EU) 2016/679 of the European Parliament and of the Council, of 27 April 2016, regarding the protection of natural persons with regard to the processing of personal data and the free circulation of these data and other regulations that may be applicable.
NUEVA GESTION INFORMATICA, S.L. communicates in this writing to the company user of the application and this expressly declares it to know and accept, that in no case will it accept to be in charge of processing those personal data that reveal ethnic or racial origin, political opinions, religious convictions or philosophical, or union affiliation, as well as genetic data, biometric data aimed at uniquely identifying a natural person, data related to health or data related to the sexual life or sexual orientation of a natural person.
The user company of the application informed of this waiver is declared in this document if access to the data is necessary for the provision of the service.
